Without prejudice to the above, the Controller reserves the right to remove any unlawful or illegal content.
2. CATEGORIES OF PERSONAL DATA
The personal data subject to processing are those provided by the User when filling out the online registration form on the various sites managed by the Controller, through social networks, the front-office service, or by any other permitted means (chat, telephone, e-mail).

End users (artists, visitors to exhibitions and events)

Business data: company name and business activity.
Upon registration, the User acknowledges and accepts that his/her user profile will be made publicly visible on the sites connected to the Owner’s activities, as well as on various search engines present on the Internet.
If personal data is collected through a social network, the applicable privacy policy must be that established by that social network.
3. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER AND DATA VERIFICATION
Fields marked with an asterisk (*) in the registration form are necessary to proceed with the registration; providing data in all other fields is optional. The User guarantees that the personal data provided are true and up to date and undertakes to communicate any changes, as the User is solely responsible for any inaccuracy or falsehood in the data provided. The Data Controller declares that the personal data obtained are at all times adequate and relevant to the scope, specific purposes, and nature of the services provided.
4. PURPOSES AND LEGAL BASIS OF THE PROCESSING
User data are collected for the following purposes:
-Organizing competitions, exhibitions, and artistic events to provide visibility to interested users.
-Providing users with information on cultural events, competitions, artistic activities, exhibitions, opportunities for artists, and conferences.
-Providing information on the network of partners and professionals involved in the Controller’s activities.
-Facilitating contact (via e-mail inquiries, forms, and telephone) between partners performing cultural services in the art world and interested users.
Maintain seamless and dynamic communication with users through any medium, including social networks and instant messaging applications. In these cases, without prejudice to the application of this Privacy Policy, the privacy policies of the social networks or instant messaging applications in question also apply. – send promotional and informational communications about services and activities provided by companies, associations, and entities with which the Data Controller has commercial and non-commercial agreements (including commercial communications from professional users and third parties), relating to the cultural and artistic sector, given the nature and scope of the Data Controller’s activities. The Data Controller reserves the right to send such informative and promotional communications for the entire duration of the relationship between the User and the Data Controller, unless the User expressly states otherwise.
The personal data provided by Users is also collected for statistical purposes.
The Data Controller is authorized to process Users’ personal data for the purposes described above, as expressly recognized by applicable law, (i) if the User has given their consent and/or (ii) if the information sent relates to activities, products, and services in the artistic and cultural sector, provided that the User has not requested to no longer receive such communications.
The Data Controller may use, without the User’s consent, email and postal addresses, pursuant to and within the limits permitted by Article 130, paragraph 4, of the Privacy Code. In this case, the legal basis for processing your data for this purpose is Article 6, paragraph 1, letter f), of the Privacy Code and the provision of the Italian Data Protection Authority of 19 June 2008, Article 6 (1) (f) of the Regulation.
5. AUTOMATED DECISIONS
The Controller declares not to make decisions that may affect the User based solely on the automated processing of their personal data. All decision-making processes involve human intervention.
6. TRANSFER OF PERSONAL DATA TO THIRD PARTIES
The Controller may share Users’ personal data with the categories mentioned in Art. 2 to fulfill contractual and partnership obligations. Furthermore, data may be transferred to jurors and partners of competitions for the selection of winners and the awarding of prizes, under strict confidentiality agreements.
The Data Controller also has the right to transfer Users’ personal data to the following recipients and for the reasons indicated: judges and partners of the competitions organized by the Data Controller for the identification of the winners and the creation of the prizes offered and with whom the Data Controller has signed the confidentiality agreements and contracts for the processing of personal data required and imposed by current legislation to protect the privacy of Users.
The Data Controller undertakes to promptly inform the User in the event of future transfers of personal data.
7. INTERNATIONAL TRANSFERS OF PERSONAL DATA
Pursuant to current data protection legislation, for the proper provision of the services managed by the Data Controller, User data may be transferred to international partners with whom the Data Controller collaborates and with whom the Data Controller has signed the relevant data processing agreement containing the standard contractual clauses adopted by the European Commission.

8. DATA RETENTION
User data (email address, first name, and last name) is stored on Mailchimp and MailUp servers, services used by the Data Controller to manage and send its newsletters. The lists correspond to the various activities carried out by MOCA (MODERN AND CONTEMPORARY ART) APS, the data controller. Like any newsletter management platform, MailUp and Mailchimp provide information on newsletter opening practices and clicks on links contained therein, information the Data Controller uses for statistical purposes.
The Data Controller will continue to process Users’ Personal Data for informational and marketing purposes until consent is withdrawn. The User may withdraw their consent at any time by using the unsubscribe button found in all newsletters received or by sending an email to info@mocaitalia.com.

9. EXERCISE OF DATA SUBJECT RIGHTS AND COMPLAINTS
Pursuant to Articles 15 et seq. of the GDPR, the User has the right to exercise the rights of access, rectification, erasure, portability, restriction of processing, and/or objection to processing. 10. PERSONAL DATA OF MINORS
